1. Acceptance of these Terms

By accessing or using the Souq elbeet website at https://souqelbeet.com, the Souq elbeet mobile application, or any related services, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Service.


These Terms apply to all visitors, customers, users, sellers, productive families, delivery representatives, and any other person who accesses or uses the Service.


2. Definitions

For the purposes of these Terms:


“Application” means the Souq elbeet mobile application.

“Company”, “Souq elbeet”, “we”, “us”, or “our” means Souq elbeet, the provider of the Service.

“Country” means the Kingdom of Saudi Arabia.

“Customer”, “User”, “you”, or “your” means any person or entity using the Service.

“Order” means a request placed through the Service to purchase, reserve, collect, or deliver products.

“Representative” or “Courier” means a delivery or purchasing representative who may purchase, collect, or deliver products on behalf of a user.

“Seller” means any third-party seller, merchant, productive family, store, or service provider offering products through or in connection with Souq elbeet.

“Service” means the Souq elbeet website, application, marketplace, ordering system, delivery services, representative purchasing services, customer support, and any related features.

“Terms” means these Terms and Conditions.


3. About Souq elbeet

Souq elbeet is an e-commerce platform and online marketplace. The Service allows users to browse and purchase products, place delivery orders, communicate with support, and request a representative or courier to purchase or collect certain items on the user’s behalf, subject to availability, delivery coverage, applicable fees, and these Terms.


Souq elbeet may offer products directly and may also display products or listings from third-party sellers, productive families, stores, or other partners.


4. Eligibility and Accounts

You must be at least 18 years old, or use the Service under the supervision and consent of a parent or legal guardian, to create an account or place an order.


You agree to provide accurate, complete, and up-to-date information when creating an account, placing an order, adding an address, or using any payment or delivery feature. You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.


We may refuse registration, suspend an account, cancel orders, or restrict access to the Service if we reasonably believe that the information provided is inaccurate, fraudulent, unsafe, illegal, or in breach of these Terms.


5. Orders and Order Acceptance

Placing an order through the Service does not mean that the order has been accepted. An order is accepted only when Souq elbeet, the seller, or the relevant representative confirms that the order can be processed.


Products, prices, availability, delivery areas, delivery times, and fees may change before an order is confirmed. We may reject, cancel, or modify an order when products are unavailable, prices are incorrect, the address is outside the delivery area, payment is not completed, the order appears suspicious, or the order violates these Terms or applicable law.


6. Representative Purchasing Service

Users may request a Souq elbeet representative or courier to purchase or collect items on their behalf from available stores or locations.


By placing such a request, you authorize the representative to purchase, collect, or arrange delivery of the requested items according to the instructions you provide. You understand that product availability, store prices, stock levels, packaging, quality, and delivery times may vary.


If an item is unavailable, has a different price, requires a substitute, or involves additional charges, we may contact you for approval before completing the order. If we cannot reach you within a reasonable time, we may cancel the order, proceed with a reasonable substitute only if you have allowed substitutions, or take any other action reasonably necessary to protect both parties.


You are responsible for providing clear instructions, accurate product details, correct quantities, correct address information, and a reachable phone number.


7. Sellers and Third-Party Products

Some products may be supplied by third-party sellers, productive families, stores, or other merchants. Where a product is supplied by a seller, that seller may be responsible for the product description, stock availability, product quality, warranties, defects, returns, and any seller-specific policies, subject to applicable consumer protection laws.


Souq elbeet may act as a platform, marketplace, intermediary, delivery provider, or purchasing representative depending on the type of order. We will make reasonable efforts to help resolve customer issues, but we are not responsible for matters that are controlled exclusively by the original seller or store, except where applicable law requires otherwise.


8. Prices, Fees, and Taxes

Prices are displayed in Saudi Riyals unless otherwise stated. Orders may include product prices, service fees, delivery fees, representative purchasing fees, payment processing fees, taxes, and any other charges shown before order confirmation.


For representative purchasing requests, final prices may differ from prices displayed in the Service if the original store changes the price, charges additional fees, or if the item is substituted with your approval.


We reserve the right to correct pricing errors and to cancel orders affected by obvious pricing or technical mistakes.


9. Payment

You agree to pay all amounts due for your order using one of the payment methods available through the Service. Payments may be processed by third-party payment providers, banks, card networks, wallet providers, or other payment partners.


We do not control the full operation of third-party payment systems. Payment failures, refunds, chargebacks, authorization holds, bank delays, or payment provider errors may be subject to the rules and processing times of the relevant payment provider.


10. Delivery

Delivery times are estimates only and are not guaranteed. Delivery may be affected by product availability, seller preparation time, distance, traffic, weather, courier availability, payment verification, incorrect address details, inability to contact the user, or events outside our reasonable control.


You must provide a complete and accurate delivery address and be available to receive calls, messages, or delivery attempts. If delivery fails because of incorrect information, absence, refusal to receive the order, or failure to respond, additional delivery, cancellation, or return fees may apply.


11. Cancellations, Returns, and Refunds

Cancellation, return, and refund rights depend on the order status, the type of product, the seller’s policy, the original store’s policy, the condition of the product, and applicable laws.


You may request cancellation before the order is accepted or before the seller, store, representative, or courier starts preparing, purchasing, collecting, or delivering the order. Once processing has started, cancellation may not be possible or may be subject to service, delivery, purchasing, restocking, or third-party fees.


Products must generally be returned unused, undamaged, complete, and in their original packaging, unless the product is defective or the applicable law provides otherwise. Certain products may not be returnable, including perishable food, customized items, opened hygiene products, digital goods, time-sensitive items, or any products that cannot be returned for health, safety, or legal reasons.


Refunds, where approved, will usually be issued to the original payment method or as store credit, depending on the payment method, order type, and applicable policy. Bank and payment provider processing times may vary.


12. Prohibited and Restricted Items

You may not use the Service to request, purchase, sell, deliver, or facilitate any illegal, prohibited, unsafe, counterfeit, stolen, restricted, or age-restricted item.


Prohibited items include, without limitation, weapons, explosives, alcohol, narcotics, controlled substances, prescription-only medicines without proper authorization, hazardous materials, counterfeit goods, stolen goods, products that infringe intellectual property rights, and any product prohibited under the laws and regulations of Saudi Arabia.


We may refuse or cancel any order that we believe violates this section, and we may report suspicious or illegal activity to the relevant authorities where required or permitted by law.


13. User Conduct

You agree not to misuse the Service. You must not:


- provide false, misleading, or incomplete information;

- place fake, abusive, or fraudulent orders;

- harass, threaten, insult, or abuse sellers, representatives, couriers, support agents, or other users;

- attempt to access accounts, systems, or data without authorization;

- copy, scrape, reverse engineer, interfere with, or disrupt the Service;

- use the Service for illegal activities or for products prohibited by these Terms;

- violate the rights of Souq elbeet, sellers, representatives, or third parties.


14. Product Information and Availability

We try to keep product information, images, prices, stock status, descriptions, and delivery information accurate and updated. However, some information may be provided by sellers, stores, or third parties, and may change without notice.


Product images are for illustration purposes only. Actual products, colors, packaging, ingredients, sizes, and specifications may differ from the images shown in the Service.


15. Offers, Promotions, and Coupons

Offers, discounts, coupons, loyalty benefits, wallet credits, and promotional campaigns may be subject to additional terms, expiry dates, minimum order values, product exclusions, seller exclusions, delivery-area restrictions, usage limits, and other conditions.


We may modify, suspend, or cancel any promotion if we detect misuse, fraud, technical errors, or any breach of these Terms.


16. Communications

By using the Service, you agree that we may contact you by phone, SMS, email, WhatsApp, in-app messages, push notifications, or other available channels for order updates, delivery coordination, customer support, account security, service notices, and promotional communications where permitted by law.


You may unsubscribe from marketing emails or promotional communications where an unsubscribe option is provided. Service-related messages, such as order confirmations and delivery updates, may still be sent as necessary to provide the Service.


17. Privacy and Personal Data

Your use of the Service is also subject to our Privacy Policy. The Privacy Policy explains how we collect, use, disclose, store, and protect personal information such as name, phone number, email address, delivery address, account information, order history, payment-related information, device information, and usage data.


By using the Service, you acknowledge that personal information may be processed as necessary to operate the Service, process orders, provide delivery, communicate with you, prevent fraud, comply with legal obligations, improve the Service, and provide customer support.


18. Intellectual Property

All trademarks, logos, names, designs, text, graphics, software, code, layouts, icons, images, content, and other materials used in the Service are owned by Souq elbeet, our licensors, sellers, or other rights holders.


You may not copy, reproduce, distribute, modify, sell, rent, license, exploit, or use any part of the Service or its content without prior written permission, except as allowed by law or by these Terms.

The Service may contain links to third-party websites, payment providers, delivery providers, social media platforms, maps, analytics tools, app stores, or other third-party services. We do not control third-party services and are not responsible for their content, policies, availability, security, or practices.


Your use of third-party services may be governed by their own terms and privacy policies.


20. App Stores

If you download the Application through the Apple App Store, Google Play Store, or another application store, you may also be subject to that store’s terms, rules, and policies. The relevant application store is not responsible for providing support, maintenance, refunds, or any claims relating to the Service except where required by its own rules or applicable law.


21. Suspension and Termination

We may suspend or terminate your access to the Service, cancel orders, remove content, restrict payment methods, or take other protective actions if we reasonably believe that you have breached these Terms, violated the law, misused the Service, harmed another party, or created a risk to Souq elbeet, sellers, representatives, couriers, or users.


You may stop using the Service at any time. Termination does not affect rights or obligations that arose before termination, including payment obligations, refund handling, dispute resolution, and sections intended to survive termination.


22. Disclaimer

The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will always be uninterrupted, error-free, secure, available, or free from technical problems.


To the maximum extent permitted by applicable law, we disclaim warranties that are not expressly stated in these Terms. Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.


23. Limitation of Liability

To the maximum extent permitted by applicable law, Souq elbeet will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of business, or loss of goodwill.


Where liability cannot be excluded under applicable law, our liability will be limited to the amount actually paid by you for the affected order or the maximum amount permitted by law, whichever is lower, unless applicable law requires a different standard.


24. Indemnity

You agree to indemnify and hold Souq elbeet, its owners, employees, representatives, agents, sellers, partners, and service providers harmless from any claims, losses, damages, liabilities, costs, or expenses arising from your misuse of the Service, breach of these Terms, violation of law, false information, prohibited orders, or infringement of third-party rights.


25. Force Majeure

We will not be responsible for delay or failure to perform where caused by events outside our reasonable control, including natural disasters, severe weather, fires, epidemics, government actions, road closures, internet or telecommunications failures, payment provider failures, labor disputes, supply shortages, or other similar events.

We may update these Terms from time to time. The updated version will be posted on the Service with a new “Last updated” date. If changes are material, we will make reasonable efforts to notify users where appropriate.


Your continued use of the Service after the updated Terms become effective means that you accept the updated Terms.


27. Governing Law and Dispute Resolution

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia, without regard to conflict of law principles.


If you have a concern, complaint, or dispute, you agree to first contact Souq elbeet so that we can try to resolve the matter informally. If the dispute cannot be resolved informally, it may be submitted to the competent courts or authorities in the Kingdom of Saudi Arabia, unless applicable law requires another forum.
